How does a notary help me in the buying and selling process?

Before the purchase-sale

It is essential that, before starting the signing of the contract or committing to the purchase, we contact a notary, who will confirm certain basic aspects of the property, such as, for example, that the person selling it is really the owner; and if he is the sole owner or if the consent of third parties has to be requested.

They will also be able to verify that there is no inconclusive succession and that the property does not have a mortgage.
Also, the notary, depending on the local legislation, will process the proof that the property is free of encumbrances and up to date in the payment of its taxes, such as IBI and water or land use certificates.

During the sale and purchase

At the moment of the purchase-sale, the first step is to have all the documentation ready, then the notary will prepare the corresponding deed and will coordinate a meeting for the signing in which the buyer, the seller, the financial entity in the case that the property is acquired through a mortgage loan and the notary are present.

After the purchase-sale

Once the purchase-sale process is concluded, the notary is in charge of registering the deed in the Public Registry of Property so that there is a record of the purchase-sale, thus finalizing the deed process.

The notary is also in charge of delivering you an original testimony of the deed, as well as to conserve the original protocol where your deed is registered during 5 years in the notary's office, after which it will be delivered to the General Archive of Notary's offices.
